According to Colorado’s statutes of limitations, accident victims have three years from the date of the accident to file a lawsuit—in other words, don’t delay contacting an attorney, if you think you have a case.

Colorado follows the modified comparative negligence legal theory. So, as long as you’re less than 50 percent responsible for the accident, you can still seek to recover damages.

However, any compensation you receive will be reduced proportionally by any fault you may share in causing the accident. For instance, if you’re deemed 10 percent at fault, the compensation available is reduced by 10 percent.
